General terms and conditions of sale

These General Terms and Conditions of Sale (hereinafter the “Terms”) govern the offer and sale of products and services (e.g. admission tickets, bookshop products) through the website of Fondazione Luigi Rovati ETS (hereinafter the “Foundation” or the “Seller”).
Art. 1 – Subject of the Contract
These Terms apply to any purchase agreement concluded between the Foundation and the user (hereinafter the “Customer”) through the Foundation’s website.
Art. 2 – Pre-Contractual Information for Consumers (Art. 49 Italian Consumer Code)
Before concluding the purchase agreement, the Customer reviews the characteristics of the goods and services described in the individual product pages.
Before validating the order, the Customer is informed about:
a) Identity and contact details of the Seller: Fondazione Luigi Rovati ETS, registered office at Corso Venezia 52, 20121 Milan (MI), email: rpd-fondazioneluigirovati@fidimholding.com.
b) Total price of the goods/services, including taxes.
c) Payment methods.
d) Conditions, terms and procedures for exercising the right of withdrawal (where applicable).
e) Existence of the legal guarantee of conformity for purchased goods.
Art. 3 – Conclusion of the Contract
- The sales contract is considered concluded when the Foundation sends the Customer an order confirmation email. The email contains the Customer’s details, the order number, the price of the purchased good/service, and a link allowing the Customer to print and store a copy of these Terms.
- The Customer undertakes to verify the accuracy of the personal data contained in the confirmation email and to promptly notify the Foundation of any corrections.
Art. 4 – Prices and Payment Methods
- All prices for products and services displayed on the website are expressed in Euros and include VAT.
- The Customer may make payment using the methods indicated during the purchase process (e.g. credit card, PayPal, or other electronic payment systems). Transactions are processed through secure systems ensuring the protection of payment data.
Art. 5 – Provision of Services and Delivery of Products
- Admission Tickets: Tickets purchased online are digital access tickets (e-tickets) sent to the email address provided by the Customer. The ticket must be presented at the entrance control point either digitally on a smartphone or in printed format.
- Physical Products (Bookshop): For the purchase of physical goods, delivery will be made by courier to the address provided by the Customer. Shipping costs and delivery times are specified during the purchase process.
Art. 6 – Exclusion of the Right of Withdrawal for Tickets
- Pursuant to Art. 59, paragraph 1, letter n) of the Italian Consumer Code (Legislative Decree 206/2005), the right of withdrawal is excluded for “contracts for the supply of services related to leisure activities where the contract provides for a specific date or period of performance.”
- Since admission tickets sold by the Foundation relate to services provided on a specific date and/or within a specific period of performance (day and time slot of the visit), the Customer is not entitled to a right of withdrawal.
- Once the purchase has been completed, tickets cannot be cancelled, modified, or refunded. No refund is provided in the event the Customer does not use the ticket.
- Ticket refunds are only available in the event of cancellation of the event or closure of the museum by the Foundation. In such cases, the Foundation will inform Customers and provide instructions on how to obtain a refund.
Art. 7 – Legal Guarantee of Conformity
For the purchase of physical products (e.g. bookshop merchandise), the Customer benefits from the legal guarantee of conformity provided under Articles 128 et seq. of the Italian Consumer Code. In the event of defective or non-conforming products, the Customer is entitled to restoration of conformity free of charge through repair or replacement.
Art. 8 – Processing of Personal Data
The Customer’s personal data are processed by the Foundation in compliance with applicable personal data protection legislation, as specified in the website’s Privacy and Cookie Policy.
Art. 9 – Applicable Law and Dispute Resolution
- These Terms are governed by Italian law.
- Any dispute relating to the application, execution, or interpretation of these Terms shall fall under the jurisdiction of the court of the Customer’s place of residence or domicile, if located within the territory of the Italian State.
